I am not a judge or an arbitrator and I will not decide who is right or wrong. I act as a facilitator to help participants reach a settlement which they will own.
Traditional bargaining focuses on defending positions rather than addressing underlying concerns. This leads to a contest of wills and almost inevitable win:lose, lose:win, or lose:lose scenarios. Mediation offers the chance of a true win:win.
Mediation is invariably a better option than court proceedings. Better still is to avoid conflict altogether.
Using principles of mediation I encourage stakeholders to pre-empt conflict by investigating dissonant interests before they become toxic. This is especially important in the context of family businesses.
